This information is used solely for billing and customer service purposes when you order from neweditionsart.com and is always encrypted and transmitted safely over the Internet using Secure Sockets Layer (SSL) technology.

How That Information Is Used

NEW EDITIONS values our customers and we are committed to your privacy. We understand that you and your information is one of NEW EDITIONS' most important assets and will not sell, rent, or distribute your name, e-mail address or other identifiable information to any third party under any circumstance. This includes any data we collect for our mailing list.

The only exceptions to the foregoing are that we may disclose personally identifiable information (i) in response to legal process, for example, in response to a court order or subpoena, (ii) in response to a law enforcement agency’s request, or where we believe it is necessary to investigate, prevent, or take actions regarding suspected illegal activities, suspected fraud, situations involving potential threats to the physical safety of another person, violations of our terms of use, or as otherwise required by law or policy, or (iii) in the event we are acquired by or merged with another company.

2. STORE POLICIES

Hand Made Products

NEW EDITIONS prints are handmade works of art. We do everything that we can to represent each work accurately through our website and all other promotional materials, but because browsers and computer screens differ, and because they are made to order and cut by hand, all sizes and colors are approximate and cannot be guaranteed.

Safe Shopping
You can shop at neweditionsart.com online with confidence. We have partnered with Authorize.Net, a leading payment gateway since 1996, to offer safe and secure credit card and electronic check transactions for our customers.

The Authorize.Net Payment Gateway manages the complex routing of sensitive customer information through the credit card and electronic check processing networks (see an online payments diagram). The company adheres to strict industry standards for payment processing, including:

Processing & Shipping

We ship via USPS, UPS and FedEx within the continental United States. UPS and FedEx ship to street addresses only.

With all online orders your order is accepted when goods are shipped. We make every effort to process and ship your order within 3-5 days of receiving it. Deliveries via Ground Shipping (USPS, UPS or FedEx) normally take 5-7 business days once shipped. If you’re in a hurry, expedited shipping (Next Day Air) is available on most items at an additional charge.

Refunds & Returns: Experience art, Stress free

If you are not satisfied with a print, you may return it in good condition for a prompt refund, credit or exchange, less shipping charges, within 14 days of purchase. All prints must be returned in the condition that they were received in the original packaging. If a print is returned with any type of damage to the surface or edges of the print a refund will not be granted. There are no refunds for gift cards.

Please mail your return and a copy of your invoice to: NEW EDITIONS, 453 S. Spring St. Ste. 641, Los Angeles, CA 90013. We recommend that you send returns by recorded delivery, as we cannot be held responsible for prints lost or damaged in transit. Prints are returned to NEW EDITIONS at your own cost.

We do everything we can to ensure that your prints are delivered to you safely in perfect condition. If your print appears to have been damaged during shipping, kindly contact us immediately at (877) 639-3386 or (213) 239-0059. You may also email us. Please retain all packaging so that it may be inspected in the event of a claim. It is important that you contact us within 7 days of delivery of damaged prints or we cannot process a claim.

3. LEGAL POLICIES

No Warranty

SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES AND NEW EDITIONS SUPPLIERS PROVIDE NEW EDITIONS WEB SITE AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. NEW EDITIONS SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES AND NEW EDITIONS SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. SOME STATES DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE FOREGOING DISCLAIMER MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE.

Liability Limit

IN NO EVENT SHALL NEW EDITIONS, AND NEW EDITIONS SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES OR NEW EDITIONS SUPPLIERS BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR SITE, OUR SERVICES OR THIS AGREEMENT (HOWEVER ARISING, INCLUDING NEGLIGENCE).

NEW EDITIONS LIABILITY, AND (AS APPLICABLE) THE LIABILITY OF NEW EDITIONS SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO THE GREATER OF (A) THE AMOUNT OF FEES YOU PAY TO NEW EDITIONS IN THE 12 MONTHS PRIOR TO THE ACTION GIVING RISE TO LIABILITY, AND (B) $350. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

Indemnity

YOU AGREE TO INDEMNIFY AND HOLD NEW EDITIONS AND (AS APPLICABLE) NEW EDITIONS PARENT, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, AGENTS, AND EMPLOYEES, HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING REASONABLE ATTORNEYS FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF YOUR BREACH OF THIS AGREEMENT OR THE DOCUMENTS IT INCORPORATES BY REFERENCE, OR YOUR VIOLATION OF ANY LAW OR THE RIGHTS OF A THIRD PARTY.

Legal Compliance

You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of our service and your listing, purchase, solicitation of offers to purchase, and sale of items.

Severability

If any provision of this Agreement is held unenforceable, then such provision will be modified to reflect the parties' intention. All remaining provisions of this Agreement shall remain in full force and effect.

Governing Law

This Agreement shall be governed by the laws of the United States and the State of California, applicable to agreements made and to be performed therein without regard to conflict of laws principles.  The parties hereby irrevocably consent to the jurisdiction of the state and federal courts located in Los Angeles, California, in any action arising out of or relating to this Agreement, and waive any other venue to which any party might be entitled by domicile or otherwise.

Notification

For purposes of the Digital Millennium Copyright Act (DMCA), 17 U.S.C. Sec. 512, NEW EDITIONS has designated an agent for notification of claimed infringement in writing as follows: Patrick Lakey, NEW EDITIONS, LLC, 453 S. Spring St. Ste. 641, Los Angeles, CA 90013. NEW EDITIONS provides this contact information for purposes of the DMCA only and reserves the right to respond only to correspondence that is relevant to the purposes of compliance. You acknowledge that if you fail to comply with all of the requirements of the statute, your DMCA notice may not be valid.

Resolution of Disputes

We want you to be absolutely satisfied with your experience at NEW EDITIONS. If you are not for any reason, please feel free to contact us at and we will work with you to resolve any issue you may have.

Compliance With Full Disclosure in the Sale of Fine Prints

An art dealer shall not cause a catalogue, prospectus, flyer or other written material or advertisement to be distributed in, into, or from this state which solicits a specific multiple, unless it clearly sets forth, in close physical proximity to the place in such material where the multiple is described, the descriptive information required by Section 1744 for any time period. In lieu of this required information, the written material or advertising may set forth the material contained in the follwing quoted passage, or the passage itself, if the art dealer then supplies the required information prior to or with delivery of the multiple. The nonobservance of the terms within the following passage shall constitute a violation of this title:

“California law provides for disclosure in writing of information concerning certain fine prints, photographs, sculptures prior to effecting a sale of them. This law requires disclosure of such matters as the identity of the artist, the artist’s signature, the medium, whether the multiple is a reproduction, the time when the multiple was produced, use of the plate which produced the multiple, and the number of multiples in a “limited edition.” If a prospective purchaser so requests, the information shall be transmitted to him or her prior to payment, or the placing of an order for a multiple. If payment is made by a purchaser prior to delivery of the multiple, this information will be supplied at the time of or prior to delivery, in which case the purchaser is entitled to a refund if, for reasons related to matter contained in such information, he or she returns the multiple in the condition in which received, within 30 days of receiving it. In addition, if after payment and delivery, it is ascertained that the information provided is incorrect, the purchaser may be entitled to certain remedies, including refund upon return of the multiple in the condition in which received.”

This requirement is not applicable to general written material or advertising which does not constitute an offer to effect a specific sale.

4. USER AGREEMENT

The NEW EDITIONS website (including, without limitation, text, photographs, images,  graphics, video and audio content) is protected by copyright as a collective work or compilation under the copyright laws of the United States and other countries.  All individual content and other elements comprising the NEW EDITIONS offered for sale are also copyrighted works of the artists.  You must abide by all copyright notices or restrictions contained in the NEW EDITIONS website, and all rights of relevant third parties.

 Unless you receive prior written authorization from NEW EDITIONS, you may not copy, reproduce, distribute, publish, enter into a database, display, perform, modify, create derivative works, transmit, or in any way exploit any part of the NEW EDITIONS website or the works of artists contained in or on the NEW EDITIONS website.

The NEW EDITIONS website is hosted in the United States and is intended for and directed to users in the United States.  If you access the NEW EDITIONS website from the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from U. S. laws, please be advised that through your continued use of the NEW EDITIONS website, which is governed by U.S. law, this Privacy Policy, and our User Agreement, you are transferring your personal information to the United States and you consent to that transfer.  Also, irrespective of your location, please note that your information may be stored and processed in the U. S. or any other country where NEW EDITIONS has facilities, and by subscribing to our services, you consent to the transfer of information outside of your country.

The NEW EDITIONS Service is controlled and offered to you from facilities in the United States of America. We make no representations that the NEW EDITIONS Service is appropriate or available for use in other locations.
